General Terms and Conditions ("GTC") (prepared in accordance with Act No. 40/1964 Coll., Civil Code, Act No. 513/1991 Coll., Commercial Code, Act No. 250/2007 Coll. On Consumer Protection and Act No. 22 / 2004 Coll. On electronic commerce)
These General Terms and Conditions (hereinafter referred to as "GTC") govern the rights and obligations of the buyer and Enigmatix s.r.o., with its registered office at Ota Holúska 1A, 841 06 Bratislava, Company Identification Number: 53560272, entered in the Commercial Register of the District Court of Bratislava I, Section Sro, File No. 92862 / B (hereinafter referred to as “Enigmatix” or “Seller”) as the seller concluding purchase contracts via the Internet, the subject of which is the purchase of goods through an online store located on the website www.zuzanamihalechova.com.
Who is a registered customer?
It is simple, a natural or legal person who has filled in the registration form, including personal data on the website www.zuzanamihalechova.com, can become a registered customer. Data marked with an asterisk are mandatory data and their completion is necessary for successful registration. Customer registration is not a condition for using the online store www.zuzanamihalechova.com, but it is associated with the benefits provided by Enigmatix (ability to monitor the status of orders, an overview of all orders already placed, download invoices, regular information about news and promotions).
Conclusion of the purchase contract
The buyer orders the goods from the seller by filling out the form provided on the website www.zuzanamihalechova.com. The order is considered sent at the time of delivery to the seller, if it contains all the required information. The sent order is a proposal of the buyer to conclude a purchase contract with the seller. A summary of the order, which will be sent to the buyer's e-mail address, is considered acceptance of the order, on the basis of which the purchase contract is concluded. The order summary contains the order number, information about the buyer - billing and delivery address, telephone or email contact, information about the seller, type of goods, number of pieces, price, delivery costs and method of payment. The order is also registered in the "orders" section. By concluding the purchase contract, the seller undertakes to deliver the ordered goods to the buyer in the required quality and price. The buyer undertakes to take over the delivered goods and pay the agreed purchase price and delivery costs for them. Any change of the order after the conclusion of the purchase contract is a proposal to change the purchase contract and is possible only by mutual agreement of the buyer and seller. The order expires if the seller does not send the buyer a confirmation e-mail within 3 days of completing and sending the form. The buyer can only cancel the order if he informs the seller before the order is handed over to the buyer. The buyer informs the seller about the cancellation of the order in writing or via the form on the website of the online store www.zuzanamihalechova.com. The seller is entitled to reject the order, even tacitly, or without giving a reason.
According to Act no. 102/2014 Coll. - The Consumer Protection Act (hereinafter referred to as "CPA") for distance selling, the customer has the right to withdraw from the contract without giving a reason within 14 days of receipt of the goods. The period for withdrawal from the contract runs from the moment of taking over the goods. If the customer decides to withdraw from the contract, he is obliged to send a written notice of withdrawal from the contract. In the notice of withdrawal, the customer shall state the order number, invoice number, date of ordering and receipt of goods, name and address of the consumer and account number in the form of IBAN, to which the customer wishes to transfer funds. Withdrawal from the contract must be notified in writing at Enigmatix s.r.o., Ota Holúska 1A, 841 06 Bratislava, or by e-mail at firstname.lastname@example.org, resp. in person at Enigmatix s.r.o., Ota Holúska 1A, 841 06 Bratislava. The withdrawal period shall be deemed to have been observed if the notice of withdrawal has been sent no later than the last day of the withdrawal period. Withdrawal from the contract terminates the purchase contract. In accordance with paragraph §517 par. 1 of the Civil Code, the customer has the right to withdraw from part of the subject of the contract (if the subject of the contract was more products or types of goods). In case of withdrawal from the contract in accordance with the provisions of CPA, the customer is obliged to send the goods to the address Enigmatix s.r.o., Ota Holúska 1A, 841 06 Bratislava within 14 days from the delivery of the notice of withdrawal from the contract. The period is considered to be observed if you return the goods before the expiry of the 14-day period. Send the goods to us together with the invoice as a registered shipment. To avoid possible problems, please do not send the goods on delivery. The price for the purchased goods will be returned to you only after delivery of the returned goods back to our above address (or after proving in the form of a delivery note that the goods were sent back to our address) without undue delay, no later than 14 days unless we agree otherwise (eg by providing a discount voucher for the next purchase). The costs associated with returning the goods to our facility are borne by the customer. Upon withdrawal from the contract, you will also be refunded the cost of delivery of goods in the range of the cheapest common method of delivery from our offer. If the goods are damaged, incomplete, without the original packaging or. used, the customer is responsible for the reduction in the value of the goods, which arose as a result of such treatment of the goods, which is beyond the treatment necessary to determine the properties and functionality of the goods.
Price and payment terms
The purchase price of the goods is listed on the seller's website - www.zuzanamihalechova.com for each product in black or. brown color. For comparison, for most products, the "Current Price" of the product is also shown in black or crossed out - this is the retail recommended price at which the goods are usually sold. These prices are continuously updated based on information from the supplier's supplier and Unless otherwise stated, prices are inclusive of VAT (usually 20% VAT on products or 10% for some products.) The seller reserves the right to change the price at its discretion. costs of transporting goods from the seller's dispatch point to the place of delivery Transport costs are charged separately according to the valid price list of transport. Shares and discounts may not be combined with each other unless otherwise stated.
For orders within the Slovak Republic delivered by post, the price of the order is also charged postage in the amount of 2,50 EUR, respectively. in the amount of the price stated in the ordering process. For orders delivered by postal courier (directly to the buyer's address), a postage of 4,00 EUR will be charged, resp. in the amount of the price, which is stated when choosing the method of transport in the ordering process. For orders delivered via the Mail Order network, a fee of 2,00 EUR, resp. in the amount of the price stated in the ordering process. For orders within the Slovak Republic delivered by the courier company SPS, a fee of 4,00 EUR, resp. in the amount of the price stated in the ordering process. For orders delivered within and outside the EU, a shipping fee of 8,00 EUR is charged, resp. in the amount of the price stated in the ordering process. Costs for delivery of goods to the buyer are not charged for orders whose value exceeds 35,00 EUR, but this only applies if the order is sent via Slovak Post (eg deposit at the post office, package box, courier, etc.), Mailroom and courier services within the SPS within territory of the Slovak Republic. The buyer has the option to pay the seller the price agreed in the purchase contract by one of the following methods of payment: cash on delivery (payment when taking over the goods at the delivery), electronic transfer, online payment instruments or transfer to the account based on the invoice.
A fee of 1,00 EUR is charged for cash on delivery, i.e. upon receipt of the consignment, but this method of payment is not desirable. The buyer's obligation to pay the purchase price is considered fulfilled when the purchase price is credited to the seller's account specified in the order confirmation, or by handing over the purchase price to the courier or paying the purchase price at the post office. The buyer also undertakes to indicate the correct variable symbol stated in the order confirmation. The buyer is fully aware that the indication of an incorrect variable symbol may result in incorrect pairing of the payment by the electronic system, or non-pairing of the payment, which may be considered as non-payment of the purchase price.
Delivery time in which Enigmatix s.r.o. delivers the goods, is listed for each product separately, has an indicative character and means, within how many working days from the conclusion of the purchase contract, the buyer usually sends the consignment, or hands over the consignment to the courier. Delivery to the courier usually takes 2 to 7 days, depending on the type of transport chosen by the buyer. The determination of the delivery time depends on the stock of the seller and the stock of the suppliers. Delivery time of products resp. Other items usually range from 12 hours to 15 business days. In the event that the buyer finds the delivery time (processing time) unreasonably long, the buyer has the right to cancel the order before shipping the goods. The buyer will cancel the order via the form on the website www.zuzanamihalechova.com in the section my account - orders, but only if the buyer is a registered customer of the online store www.zuzanamihalechova.com or in another case by e-mail at email@example.com. The registered customer can check the status of order processing in the "my orders" section. In case of payment of the order by electronic payment, the funds will be returned within 14 days from the cancellation of the order to the customer's bank account (the bank account number in the form of IBAN will notify customer in writing to the seller). Order cancellation for an unregistered customer can only be made in writing, by e-mail or by telephone.
If the goods are marked "Stock" and resp. "We ship immediately" means that the goods are located directly in the seller's warehouse and the shipment usually takes place on the same, respectively. the next working day from the receipt of the order. If the goods are marked "Delivery within 7 working days", it means that the goods are in the external warehouse of the seller's supplier and the goods will be dispatched as soon as possible depending on the delivery from the supplier.
In the case of more difficult-to-access products for which the supplier has indicated an incorrect delivery time, the delivery time may be extended, of which the buyer will be notified as soon as the seller finds out more about the product's availability, either by phone, e-mail or through the buyer's user account. .
By accepting the GTC, the customer agrees to extend the delivery time if it is not possible to deliver all the ordered goods within the agreed period. The seller can divide and deliver the order in parts to speed up the delivery of individual products. In this case, the remaining transport costs are paid by the seller and the buyer pays only the price of transport that was stated with the original order. The buyer is entitled to request a split of the order mainly due to the acceleration of delivery of products, but in this case the remaining transport costs are paid by the buyer. In the event that the ordered product has sold out for any reason, resp. it is not possible for the seller to secure the product, the seller has the right to cancel the order of the product. The seller will inform the buyer about this situation, either by phone, in writing, by e-mail, or through a user account at www.zuzanamihalechova.com. In the case of payment of the order by electronic payment, the funds will be returned within 14 days to the customer's bank account (the bank account number in the form of IBAN will be notified by the customer in writing to the seller).
For products that have not yet been issued "Presale" or. "New" is the delivery time as well as the date of issue stated on the page only as a guide and without obligation. The release date of the product for pre-sales is updated based on information from the publisher or. supplier of the product. Product marked as "Presale" resp. The "novelty" will be dispatched as soon as possible after its delivery to the seller's warehouse.
The product, which has the status "Sold out", cannot be ordered at the moment, please inquire about any reprints by phone or by e-mail.
Place and method of delivery of goods
The commitment of Enigmatix s.r.o. to deliver the goods is fulfilled by handing over the goods to the customer, resp. to the authorized person specified in the order, or by handing it over to the first carrier for transport, resp. if Enigmatix s.r.o. was ready to hand over the goods to the buyer at the agreed place and time and the buyer did not take over the goods for reasons other than those on the part of Enigmatix s.r.o. In the event that the buyer does not take over the goods within the specified period or If the goods are returned to Enigmatix s.r.o., Enigmatix s.r.o. is entitled to withdraw from the purchase contract and demand from the buyer reimbursement of transport costs associated with the unsuccessful delivery of the goods.
The place of delivery is considered to be the address which the buyer stated during the order as the place of delivery and the supplier confirmed it as the place of delivery in the order confirmation. Delivery of goods will be made through a courier company, or through Slovenská pošta a.s., or the buyer can pick up the goods in person at Enigmatix s. r. o., Ota Holúska 1A, 841 06 Bratislava.
On the preparation of goods and delivery to the transport company or. The customer will be informed of the possibility to pick up the goods at the collection point, either by e-mail, telephone or SMS.
Delivery of the consignment by Slovak Post takes 2-5 days depending on the place of delivery, delivery by courier service is within 24 hours of collection of the consignment by the carrier (delivery takes place only on working days). Delivery via Mail Order takes 2-5 days. You can find exact information about the dates, conditions of delivery and the place where the consignment is located on the website of Slovenská pošta (www.posta.sk) and on the website of the SPS courier service http://www.sps-sro.sk. The prices listed in the table apply only to the sending of ordinary shipments within the Slovak Republic, and only when sending the entire order in one shipment. Prices of postage are listed including VAT. If the order is divided into several shipments, the postage may be increased by the value corresponding to the number and type of shipments.
Consent to the processing of personal data in accordance with Art. 6 par. 1 letter a) and Art. 7 Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, repealing Directive 95/46 / EC (General Data Protection Regulation). client will grant to the operator Enigmatix s.r.o., Ota Holúska 1A, Bratislava for the purpose of ensuring the fulfillment of the ordered services in the scope of:

This consent to the processing of personal data is a freely given, concrete, concrete, informed and unambiguous expression of my will, which I grant for the period necessary to ensure the above activities. (i.e. 5 years from the date of consent). After this period, your personal data will be mechanically destroyed (shredded) and will not be further processed in any database.
Prior to consent, I was informed of the following:
1. my personal data will not be provided to the recipient.
2. my personal data, the provision of which is voluntary, will be kept during the period of validity of the consent and will not be processed for any purpose other than that obtained.
3. as the data subject, I have the right to request from the controller access to my personal data concerning me, the right to rectify or erase them or to limit the processing, the right to object to the processing, and the right to data portability.
4. in a justified case, as the person concerned, I have the right to submit a complaint to the supervisory body, which is the Office for Personal Data Protection of the Slovak Republic.
5. I acknowledge that the cross-border transfer of my personal data to a third country does not take place.
6. I note that there is no automated decision-making, including profiling.
I may exercise my right to withdraw consent at any time, even before the expiry of the period for which the consent was granted, in the following ways:

Withdrawal of consent shall not affect the lawfulness of the processing resulting from the consent prior to its withdrawal. The company Enigmatix s.r.o. about. declares that the personal data provided is processed in accordance with the law and applicable legislation and takes care to prevent their unauthorized use.
We find out your satisfaction with the purchase by means of e-mail questionnaires within the optimization by data2shop s.r.o, in which our eshop is involved.
Use of gift vouchers
Enigmatix gift voucher with. r. about. can be used in the online store www.zuzanamihalechova.com or in the stone shops of the Enigmatix s sales network. r. about. When ordering online, the buyer can use only one gift voucher for one purchase. To redeem the voucher in the online store, the buyer enters a unique 4-digit to 6-digit code listed on the gift voucher in the appropriate box in the purchase process (step 3 Payment and delivery) and clicks the "Verify coupon" button. The system verifies the validity of the gift voucher and deducts the value of the gift voucher in the form of a discount from the total amount of the stated order, including VAT.
When redeeming a gift voucher in the seller's brick-and-mortar stores, the customer may redeem multiple gift vouchers at once within a single purchase. To redeem the voucher in a stone shop, the buyer must prove himself with a valid gift voucher or a unique 4-digit to 6-digit code, which is stated on the voucher.
The gift voucher is valid for 1 year from the date of purchase. The expiry date is indicated in the box on the gift voucher under the heading "Validity of the voucher until:" The value of the gift voucher is stated as an amount including VAT. The gift voucher cannot be exchanged for cash.
If the buyer applies for a gift voucher and the total amount of goods is higher than the value of the gift voucher, the buyer is obliged to pay the rest of the amount, depending on the form of payment chosen by the buyer (when buying online - cash on delivery or online payment , when buying in a stone shop - cash or payment card).
If the total value of the goods is lower than the value of the applied gift voucher, the rest of the amount is forfeited, without the right to compensation. In the case of use in brick-and-mortar stores, it is not issued from the gift voucher.
In the event of withdrawal from the contract in accordance with applicable legislation and subsequent return of goods paid for by a gift voucher, the customer will be sent the total amount of returned goods in the form of a gift voucher.
Supervision of compliance with the obligations by the seller in matters of consumer protection in accordance with applicable law is performed by the Slovak Trade Inspection, SOI Inspectorate for the Bratislava Region with its registered office at Prievozská 32, 820 07 Bratislava.
These GTC come into force on 01.08.2021.
